ユーザーの皆様はArouse Japan の利用に関して適用される、以下の利用規約を承認するものとします。この利用規約の他、Arouse Japanからリンクされた他サイト、利用する個別サービスの利用規約（本利用規約では網羅できない、個別サービス特有の規約）が存在する場合は、その利用規約に従ってください>

皆様にArouse Japanを有益に楽しんでいただくため、Arouse Japanでは以下の行為が禁止されています。

• 法令に違反する行為、および違法な行為を勧誘または助長する行為
• サーバーに負担をかける行為、および他のユーザーのアクセスまたは操作を妨害する行為
• Arouse Japanの運営またはネットワーク・システムを妨害する行為
• 他人の名誉、信用、プライバシー権、パブリシティ権、著作権、その他の権利を侵害する行為
• 他のユーザーに対する中傷、脅迫、いやがらせ、その他経済的もしくは精神的損害または不利益を与える行為。特に、本人に許可を得ずにユーザーID、ニックネーム、氏名等を特定した上での攻撃的批判（反論の機会や手段が乏しい状況下で一方的に行われている場合等）にあたる投稿を掲載することは、トラブルの元となりますのでお控えください。
• 民族・人種・性別・年齢等による差別につながる表現の掲載
• 暴力的、グロテスクな写真、死体・殺害現場等、その他一般の方が不快に感ずるイメージ（画像）、言葉、その他の表現の掲載
• 露出度の高いヌード写真(モザイク、ぼかしを入れた写真、下着姿等も含む)、胸や臀部等のアップや性器が露出した写真等、卑猥と判断される画像の掲載。イラストや絵画等もこれに含みます。
• 性行為や性器に該当する言葉、猥褻的な表現の掲載
• 児童買春・ポルノ、無修正ビデオ映像のダウンロードサイト等へのリンク掲載
• 自殺、自傷行為、薬物乱用等を美化・誘発・助長する恐れのある言葉、その他の表現の掲載
• 性交および猥褻な行為を目的とした出会い等を誘導する行為
• 選挙の事前運動、選挙運動またはこれらに類似する行為、および公職選挙法に抵触する行為
• 次に掲げる内容の情報を、Arouse Japan内の書き込み可能な箇所に投稿し、又はメッセージで送信する行為
  
  (1) 商業用の広告、宣伝を目的とする情報。ただしArouse Japan公認のものを除く。
  (2) アフィリエイトのリンクを含む情報。
  (3) ねずみ講、チェーンメール、MLM、リードメール等他人を勧誘する内容の情報。
  (4) アダルトサイトに誘導する情報（単にリンクを張る行為を含む。）。
  (5) その他弊社が不適切と判断する情報
• 無差別にメッセージを送信し、無差別にメンバー登録の追加を依頼し、又は無差別に足あとをつける行為。
• 次に掲げる行為を行うこと。
  (1) スパム投稿・スパムメッセージ　一人又は複数のユーザーが、Arouse Japan内の書き込み可能な箇所に、同一又は類似の文章を投稿し、又はメッセージで送信する行為。
  (2) スパムワード　一人又は複数のユーザーが、Arouse Japan内の書き込み可能な箇所に、当該箇所と無関係若しくは関連性の希薄な語句を複数羅列し、又は著しく長い文章若しくは大量の語句を投稿する行為。
  (3) スパムURL　一人又は複数のユーザーが、Arouse Japan内の書き込み可能な箇所に、同一のURLを投稿し、又はメッセージで送信する行為。
  (4) その他弊社がスパムと判断する行為。
• 日記やコミュニティなど、複数のユーザーが閲覧可能な場所での金融機関口座番号の記載。また、トラブルの原因となりますので電話番号の掲載もなるべくお控えください。
• あらかじめ不特定者に転売する目的で購入した商品を高額で売買することは迷惑防止条例に違反するため、禁止します。非営利の売買、交換等に関しては、禁止はしませんが他人同士の取引は危険ですのでお勧めできません。
• 自分以外の人物を名乗ったり、代表権や代理権がないにもかかわらず会社などの組織を名乗ったり、または他の人物や組織と提携、協力関係にあると偽ったりする行為。故意過失に基づき誤認した場合も含みます。
• 他のユーザーの個人情報を収集・蓄積する行為
• Arouse Japan内のサービスに関わる記載について、無断でそのコピー、複製、アップロード、掲示、伝送、配布等をする行為
• 一人のユーザーが複数のアカウントを持つ行為
• 同じアカウントを複数人で利用する行為
• 15歳未満の方のご利用
• 掲示板等でまったく面識のない方を無差別に招待する行為
• 違反行為により削除されたユーザーを招待する行為
• オークションサイト等で招待状を売買する行為
• 登録メンバーが0人の状態でご利用を継続する行為
• その他公序良俗、一般常識に反する行為
• 上記に準ずる行為

以上の行為が確認された場合、状況を判断した上で掲載情報の変更、登録削除を含めたしかるべき処置をとります。規約違反に関して連絡する場合は登録メールアドレス宛に送信させていただきます。ユーザー様のご事情により運営事務局からのメールを確認できなかった場合も、規約に則った対応をさせていただきますので予めご了承ください。なお、削除結果に関する質問・苦情は一切受け付けておりません。
判断の難しいケースに関しては、複数のスタッフにより運営基準と照らし合わせてその都度判断させていただきます。その場合、ユーザーの皆様から寄せられる通報に対して迅速な対応ができない場合がございます。

以下のいずれかにあてはまる場合には、当社はユーザーの皆様が登録した情報、利用履歴、メールの内容などの確認を行い、場合によってはこれらの情報を第三者に開示することがあります。

• 裁判所、警察、その他の司法もしくは行政機関、またはこれらに準ずる者から適法に照会があった場合
• Arouse Japanまたはそのシステムの維持に問題が生じる場合
• 法令または当社が定める規約に違反し、その他社会通念上問題があると判断された場合
• 当社、他のユーザー、またはその他の第三者の権利、または利益を保護するため必要な場合

• Arouse Japanでは、基本的にユーザー同士の通信や活動に関与しません。万一ユーザー同士の衝突があった場合も、悪質行為と判断される場合を除き、それは当事者同士で解決するものとし、当社ではその責任を負わないものとします。
• ユーザーの皆様は、Arouse Japanでの自らの行為において責任を負います。投稿等が法令違反や著作権等の権利侵害にあたる場合には、損害賠償などの民事責任の他、刑事責任を問われることがあります。
  法律またはユーザー利用規約の条項のいずれかにあなた、または他のユーザーが従わない場合には、あなたが当社に対して有する権利、主張、法的措置、訴訟、訴訟手続きの全てから当社を免除し、放免するものとします。
• プロフィール、日記などでの写真の掲載はユーザー様ご自身の責任でおこなっていただきます。具体的には、著作権、肖像権など法令上の義務に従っているか、またデータの保存、複製利用などの可能性についてもご自身の責任でおこなっていただくことになります。
• 当社は、Arouse Japanのサービスをいつでも任意の理由で中断することができます。当社は、Arouse Japan利用、または利用ができないことによって引き起こされた（直接的、間接的を問わず）損害について、一切責任を負いません。

• ユーザーの皆様はArouse Japanを利用することにより、この利用規約すべての記載内容について、同意されたものとみなされます。またこの利用規約は当社の判断で任意に変更されます。将来引き続きご利用になる場合は、その時点での内容に同意されているとみなされます。
• この利用規約の準拠法は日本法とします。また、Arouse Japanまたはこの規約に関連して当社と皆様の間で生じた紛争については東京地方裁判所を第一審専属管轄裁判所とします。

Arouse Japan is a social networking service that allows Members to create unique personal profiles online in order to find and communicate with old and new friends. The services offered by Arouse Japan.net ("Arouse Japan" or "we") include the Arouse Japan website (the "Arouse Japan"), and any other features, content, or applications offered from time to time by Arouse Japan in connection with the Arouse Japan Website (collectively, the "Arouse Japan Services"). The Arouse Japan Services are hosted in the Japan.

This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your use of the Arouse Japan Services. By using the Arouse Japan Services, you agree to be bound by this Agreement, whether you are a "Visitor" (which means that you simply browse the Arouse Japan Website) or you are a "Member" (which means that you have registered with Arouse Japan). The term "User" refers to a Visitor or a Member. You are only authorized to use the Arouse Japan Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully and save it. If you do not agree with it, you should leave the Arouse Japan Website and discontinue use of the Arouse Japan Services immediately. If you wish to become a Member, communicate with other Members and make use of the Arouse Japan Services, you must read this Agreement and indicate your acceptance during the Registration process.

This Agreement includes Arouse Japan's policy for acceptable use of the Arouse Japan Services and Content posted on the Arouse Japan Website, your rights, obligations and restrictions regarding your use of the Arouse Japan Privacy Policy. In order to participate in certain Arouse Japan Services, you may be notified that you are required to download software or content and/or agree to additional terms and conditions. Unless otherwise provided by the additional terms and conditions applicable to the Arouse Japan Services in which you choose to participate, those additional terms are hereby incorporated into this Agreement. Arouse Japan.net may modify this Agreement from time to time and such modification shall be effective upon posting by Arouse Japan.net on the Arouse Japan Website. You agree to be bound to any changes to this Agreement when you use the Arouse Japan Services after any such modification is posted. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes.

Please choose carefully the information you post on Arouse Japan.net and that you provide to other Users. Your Arouse Japan profile may not include the following items: telephone numbers, street addresses, last names, and any photographs containing nudity, or obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter. Despite this prohibition, information provided by other Arouse Japan.net Members (for instance, in their Profile) may contain inaccurate, inappropriate, offensive or sexually explicit material, products or services, and Arouse Japan.net assumes no responsibility or liability for this material. If you become aware of misuse of the Arouse Japan Services by any person, please contact Arouse Japan or click on the "Report Inappropriate Content" link at the bottom of any Arouse Japan.com page.

Arouse Japan.net reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including private messages) by you, or to restrict, suspend, or terminate your access to all or any part of the Arouse Japan Services at any time, for any or no reason, with or without prior notice, and without liability.

• Eligibility. Use of and Membership in the Arouse Japan Services is void where prohibited. By using the Arouse Japan Services, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 14 years of age or older; and (d) your use of the Arouse Japan Services does not violate any applicable law or regulation. Your profile may be deleted and your Membership may be terminated without warning, if we believe that you are under the age of 15.

• Term. This Agreement shall remain in full force and effect while you use the Arouse Japan Services or are a Member. You may terminate your Membership at any time, for any reason, by following the instructions on the Member's Account Settings page. Arouse Japan.net may terminate your Membership at any time, without warning. Even after Membership is terminated, this Agreement will remain in effect, including sections 5-17.

• Fees. You acknowledge that Arouse Japan.net reserves the right to charge for the Arouse Japan Services and to change its fees from time to time in its discretion. If Arouse Japan.net terminates your Membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of subscription fees.

• Content/Activity Prohibited. The following is a partial list of the kind of Content that is illegal or prohibited to post on or through the Arouse Japan Services. Arouse Japan.net reserves the right to investigate and take appropriate legal action against anyone who, in Arouse Japan.net’s sole discretion, violates this provision, including without limitation, removing the offending communication from the Arouse Japan Services and terminating the Membership of such violators. Prohibited Content includes, but is not limited to Content that, in the sole discretion of Arouse Japan.net:

  1. is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;

  2. harasses or advocates harassment of another person;

  3. exploits people in a sexual or violent manner;

  4. contains nudity, violence, or offensive subject matter or contains a link to an adult website;

  5. solicits personal information from anyone under 15;

  6. provides any telephone numbers, street addresses, last names, URLs or email addresses;

  7. promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;

  8. promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

  9. involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";

  10. contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);

  11. furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;

  12. solicits passwords or personal identifying information for commercial or unlawful purposes from other Users;

  13. involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;

  14. includes a photograph of another person that you have posted without that person's consent; or

  15. for band and filmmaker profiles, uses sexually suggestive imagery or any other unfair, misleading or deceptive Content intended to draw traffic to the profile.

  The following is a partial list of the kind of activity that is illegal or prohibited on the Arouse Japan Website and through your use of the Arouse Japan Services. Arouse Japan.net reserves the right to investigate and take appropriate legal action against anyone who, in Arouse Japan.net's sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities. Prohibited activity includes, but is not limited to:

  16. criminal or tortious activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets;

  17. advertising to, or solicitation of, any Member to buy or sell any products or services through the Arouse Japan Services. You may not transmit any chain letters or junk email to other Members. It is also a violation of these rules to use any information obtained from the Arouse Japan Services in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect our Members from such advertising or solicitation, Arouse Japan.net reserves the right to restrict the number of emails which a Member may send to other Members in any 24-hour period to a number which Arouse Japan.net deems appropriate in its sole discretion.

  18. covering or obscuring the banner advertisements on your personal profile page, or any Arouse Japan.net page via HTML/CSS or any other means;

  19. any automated use of the system, such as using scripts to add friends or send comments or messages;

  20. interfering with, disrupting, or creating an undue burden on the Arouse Japan Services or the networks or services connected to the Arouse Japan Services;

  21. attempting to impersonate another Member or person;

  22. for band profiles, copying the code for your Arouse Japan Player and embedding it into other profiles or asking other Members to embed it into their profiles;

  23. using the account, username, or password of another Member at any time or disclosing your password to any third party or permitting any third party to access your account;

  24. selling or otherwise transferring your profile;

  25. using any information obtained from the Arouse Japan Services in order to harass, abuse, or harm another person;

  26. displaying an advertisement on your profile, or accepting payment or anything of value from a third person in exchange for your performing any commercial activity on or through the Arouse Japan Services on behalf of that person

• Disclaimers. Arouse Japan.net is not responsible for any incorrect or inaccurate Content posted on the Arouse Japan Website or in connection with the Arouse Japan Services, whether caused by Users of the Arouse Japan Services or by any of the equipment or programming associated with or utilized in the Arouse Japan Services. Profiles created and posted by Members on the Arouse Japan Website may contain links to other websites. Arouse Japan.net is not responsible for the Content, accuracy or opinions expressed on such websites, and such websites are in no way investigated, monitored or checked for accuracy or completeness by Arouse Japan.net. Inclusion of any linked website on the Arouse Japan Services does not imply approval or endorsement of the linked website by Arouse Japan.net. When you access these third-party sites, you do so at your own risk. Arouse Japan.net takes no responsibility for third party advertisements which are posted on this Arouse Japan Website or through the Arouse Japan Services, nor does it take any responsibility for the goods or services provided by its advertisers. Arouse Japan.net is not responsible for the conduct, whether online or offline, of any User of the Arouse Japan Services. Arouse Japan.net assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any User or Member communication. Arouse Japan.net is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or on any of the Arouse Japan Services or combination thereof, including any injury or damage to Users or to any person's computer related to or resulting from participation or downloading materials in connection with the Arouse Japan Services. Under no circumstances shall Arouse Japan.net be responsible for any loss or damage, including personal injury or death, resulting from use of the Arouse Japan Services, attendance at a Arouse Japan.net event, from any Content posted on or through the Arouse Japan Services, or from the conduct of any Users of the Arouse Japan Services, whether online or offline. The Arouse Japan Services are provided "AS-IS" and as available and Arouse Japan.net expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Arouse Japan.net cannot guarantee and does not promise any specific results from use of the Arouse Japan Services.

Limitation on Liability. In no event shall Arouse Japan.net be liable to you or any third party for any indirect, consequential, exemplary, incidentual, special or puntive damages, including lost profit damages arising from your use of the services, even if Arouse Japan.net has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, “Arouse Japan.net” 's liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Arouse Japan.net for the Arouse Japan Services during the term of membership.
